Not automatically ,although Israeli law favours the mother as custodian until the child is 6. Under Section 25 of the Legal Capacity & Guardianship Law of 1962 ,where the parents do not agree about custody and the court decides on the issue , it will grant custody of a child under the age of 6 to the mother unless there are special grounds for ordering differently. Examples of special reasons which would justify the father being awarded custody of an Under-6 would be where the mother was proven to be a drug addict , a prostitute, mentally ill, had abandoned him/her , or was otherwise shown to be incapable of looking after a young child
