Maintenance / Child Support

Home / According to my divorce judgment, my ex-husband is supposed to pay my daugher child maintenence until she is 18. She suffered emotionally from the break-up, she did poorly at school, was held back a year and has not finished school yet, although she is now over 18. When she was 18 her father stopped her maintenance . Can I now file another plea for maintenance for her?

No! As a natural guardian and custodian, a mother can file a maintenance plea on her daughter’s behalf when the child is a minor. However, once the daughter reaches 18 she must file her own, independent plea. Once over 18 a child has no automatic right to maintenance.
