Does a teenager have a say in whether they should be returned to the country from where they were “abducted” ?
By: דיאנה שאלתיאל•Published on: 30 May, 2022Yes, Section 13 of the Hague Convention on the Civil Aspects of International Child Abduction states that a court may refuse to order the return of a child if it finds that the child objects to this and has attained an age and degree of maturity at which it is appropriate to take account of its views. The convention deals with minors up to the age of 16 so the views of a teenager aged between 13-16 would normally be taken into account.
