How can a custodian mother make sure that the father (her ex-husband) will keep his promise and return their minor son to Israel after the child visits the father in Canada?
By: דיאנה שאלתיאל•Published on: 17 February, 2025It is recommended that both parents reach an agreement regarding visitation, namely visits of the father in Israel to see his minor son as well as visits of the child in Canada, as well as virtual contact rights (phone/video/WhatsApp calls, Face Time etc.). If there were no provisions in this matter in the decision that appointed the mother as sole custodian then the mother is not obliged to allow visitation but considering the welfare of the child and his rights to have a meaningful relationship with both his parents, it is better to avoid legal proceedings where possible and reach an agreement which will be signed and authorized by the Family Court in Israel so that it can be enforced.
