I asked him for money towards the cost of a school bag, stationery and text books because these a costly extra expense. He refused, saying that the maintenance he pays covers this. If , however, the child does have special educational needs because he has, for example, concentration problems such as A.D.D. or A.D.H.D., or dyslexia, and he needs extra tuition by a private tutor, or needs to attend a special course, and this was not diagnosed before, or was not mentioned in the agreement/judgment, and the non-custodial parent does not co-operate and participate in the cost of these, then the custodial parent can take legal action. A plea may be filed for an increase in maintenance, based on the child’s special needs.
