My husband left me to live with another woman. I want to file him for maintenance. Does his behaviour affect the amount of maintenance I will get? I work.
By: דיאנה שאלתיאל•Published on: 16 May, 2022A Jewish man who leaves his wife for another woman is a ‘quasi-rebellious husband’. He is entitled to deduct what his wife earns from the amount of maintenance he is obliged to pay her . However, his negative behaviour can ‘increase’ the amount of maintenance he pays if she has a certain work-related benefit with a fund in her name. In a case before the Tel Aviv Family Court the wife had a benefit from the army. Normally a husband is entitled to deduct the ‘fruit’ from such a fund from the amount of maintenance he has to pay his wife. Where the husband leaves his wife for another woman he is not entitled to do so – which effectively increases her maintenance.
