International Child Abduction & Relocation

Home / My wife and I are discussing her voluntary return with our minor children (aged 8 and 11) from Hungary back to Israel. I have started Hague Convention proceedings at the Family Court in Israel for their return. I believe she is afraid of getting arrested by the police and therefore agrees to negotiate with me. Am I taking any risk by dealing with her directly and not through court?

Yes. Your wife may be trying to “trap” you by making you agree to have the children remain abroad, and taping the conversation between you, in order to use the recording, against you, in Court, to prove her defense. Your choice to act without legal representation, and negotiate directly with your wife, about returning your children, may damage your case and may supply your wife with evidence against you. You have to be very careful when you try to negotiate with your wife without legal guidance.
