Q: Before I married my partner, we signed an agreement that stipulated complete separation of property between us, but during our married life we did not act according to the agreement, we had a partnership, and I even helped him establish and develop a successful business. We are about to get divorced today, after 20 years of marriage. My ex-husband now “recalls” the document we signed, and claims that the document is a “financial agreement,” and that I have no rights in his business. I would like to point out that the agreement was not approved by a notary (before our marriage) or in court (after our marriage). Does my ex-husband have a chance, in court?

In a judgement by the Family Court in Ashdod, dated 13.1.25, an “agreement” signed before the parties’ marriage, which the husband/divorced spouse claimed was a “financial agreement”, was invalidated. This is because the court was presented with a copy of it, without notarization, which gives it the validity of a financial agreement. and because the husband/divorced husband was unable to convince the Family Court that, the document was indeed verified by a notary (File # 29787-11-22).
