Q: Can WhatsApp messages in which one parent expresses opposition to a minor’s flight with the other parent to another country be used as evidence of non-consent in a procedure under the Hague Convention?

A: Yes! If the father presents, during the lawsuit filed under the Hague Convention, messages expressing his non-consent to the minor’s transfer to another country, these messages will be used as evidence in a procedure under the Hague Convention. See, for example, the judgment given by the Central Lod District Court on 10.10.24 (File # 2298-10-24), in an appeal filed by a mother against a Family Court judgment ordering her to return a minor from Israel to New York. Both courts considered the father’s messages, who opposed her travel to Israel, and ruled that there was no consent on his part to the move.
