Q: I have lived for over 20 years in a house on a Moshav, registered in the name of my wife, who inherited it, from her parents. We are going through a divorce, and I would like to know if I have rights to the property, which is our family home?

A: Yes you may. The Israeli law case distinguishes between a whole property that was used by the parties and their children as a residential home, for which the spouse claiming partnership is required to prove little, as opposed to a case in which the parties lived in a single housing unit that does not constitute the entire household and that there was no specific intention to share it. This was determined in a ruling issued on September 7, 2023 in the Family Court in Be’er Sheva (File # 23482-12-21).
