A: For the agreement, you sign before a notary, to be legally valid, it must meet the three conditions that appear in Section 2(c1) of the Financial Relations Between Spouses Law, 1973. Meaning: (1) that this is an agreement that was signed before your marriage, (2) that the verification of the agreement was done in accordance with the Notary Law, (3) that a notarial certificate (Form 13) is attached to the agreement, and that the notary was convinced that you are both signing the agreement out of consent and understanding of its meaning and consequences. For example, an agreement between spouses was invalidated by the Family Court in Ashdod on January 13th, 2025, because the court was not presented with a notarial certificate proving that the agreement was signed and approved by a notary (Family File #29787-11-22).
