Yes – both are biological parents and according to Israeli law each is a natural guardian of the child, together with the mother, regardless of his marital status!

I am getting divorced from my wife. She is pregnant. If I am divorced before the baby is born could this mean that I lose visitation rights as a father?

No. If the divorced husband is the biological father then he , along with the mother, is the child’s natural guardian and has a right to a relationship with the minor, as the child does with him, irrespective of his marital status. In November 2003 Tel Aviv Family Court awarded visitation rights to a father who had divorced the minor’s mother when she was in her ninth month of pregnancy and he was serving a prison sentence.

Normally between two meetings during the week, and visitation every other Saturday, without a sleep-over, for a very young child. From the age of 2-3, it is normal for the weekend meetings to stretch from Friday afternoon to the end of Shabbat, on Saturday evening, including a sleep-over. Holidays and Jewish festivals are normally spent alternatively with each parent, and include sleep-overs.
